Please read these Terms and Conditions ("Terms") carefully before using PixlBank's software-as-a-service ("SaaS") platform. These Terms govern your access to and use of PixlBank's services as a business entity ("User" or "you") and set forth the legal rights and obligations between PixlBank and the User.

1. Acceptance of Terms

By using PixlBank's services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use PixlBank's services.

2. Description of Service

PixlBank offers a SaaS platform that allows businesses to enter their customers' names and addresses to generate custom postcards. PixlBank will then forward the generated postcard information to a printer under contract with PixlBank, who will print and mail the postcards to the customers on behalf of the businesses.

3. Account Registration and Use

3.1 Eligibility

To use PixlBank's services, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By creating an account, you represent and warrant that you meet these requirements.

3.2 Account Creation

You must provide accurate and complete registration information to create an account. You are solely responsible for maintaining the security and confidentiality of your account credentials. You agree to notify PixlBank immediately of any unauthorized use of your account.

3.3 User Responsibilities

You are responsible for all activities that occur under your account. You agree to use PixlBank's services in compliance with applicable laws and regulations and in a manner consistent with these Terms. You shall not engage in any activity that interferes with or disrupts the functionality of the services.

4. Intellectual Property

4.1 Ownership

PixlBank retains all rights, title, and interest in and to its services, including any intellectual property rights related thereto. These Terms do not grant you any ownership or rights to use PixlBank's trademarks, logos, or other brand elements.

4.2 License

PixlBank grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the services for your internal business purposes only. You may not sublicense, sell, rent, lease, or distribute PixlBank's services or any part thereof.

5. Data Privacy

5.1 Data Collection and Usage

PixlBank collects and processes personal information in accordance with its Privacy Policy. By using PixlBank's services, you consent to the collection, storage, and processing of your personal information as described in the Privacy Policy.

5.2 Security Measures

PixlBank employs reasonable security measures to protect your data. However, no data transmission over the internet or electronic storage system can be guaranteed to be 100% secure. You acknowledge and agree that PixlBank shall not be liable for any unauthorized access, loss, or alteration of your data.

5. Payment and Fees

6.1 Pricing

PixlBank's pricing and fees for its services are available on its website or as communicated through other means. Prices are subject to change, and PixlBank will provide notice of any such changes.

6.2 Payment Terms

You agree to pay all fees associated with your use of PixlBank's services. Fees are due as specified in the pricing plan you selected. Payments must be made through the payment methods accepted by PixlBank. Failure to pay fees may result in the suspension or termination of your account.

7. Limitation of Liability

To the extent permitted by applicable law, PixlBank shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, data, or other intangible losses, arising out of or in connection with your use or inability to use the services.

8. Termination

8.1 Termination by User

You may terminate your account and these Terms at any time by ceasing to use PixlBank's services. Any outstanding fees owed to PixlBank shall become immediately due upon termination.

8.2 Termination by PixlBank

PixlBank may suspend or terminate your access to the services, in whole or in part, for any reason or no reason, with or without notice. In the event of termination by PixlBank, any remaining credits or fees paid in advance may be refunded at PixlBank's sole discretion.

9. Modifications to the Terms

PixlBank reserves the right to modify or revise these Terms at any time. Any changes will be effective upon posting the updated Terms on PixlBank's website or through other means of notification. Continued use of the services after any such changes shall constitute your consent to the modified Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Sacramento, California.

11. Entire Agreement
